Deci.AI Ltd. (“we“, “us“, “Deci“) empowers AI developers with tools for building innovative AI-based solutions via our Automated Neural Architecture Construction (AutoNAC™), which helps organizations to quickly generate fast, accurate and efficient deep learning models (our “Platform“). This Privacy Policy (“Policy“) applies whenever Customers and Website Visitors (collectively, “you“) use our Platform or visit Deci.ai (the “Website“; the Platform and Website are hereinafter collectively referred to as the “Service(s)“) and is part of Deci Terms of Use which are incorporated herein by reference.  

We strongly urge you to read this Policy and make sure that you fully understand and agree to it. If you do not agree to this Policy, please discontinue and avoid using our Services.

You are not legally required to provide us with any Personal Data, but without it we will not be able to provide you with the best experience.

 

FROM WHOM DO WE COLLECT PERSONAL DATA:

This Policy applies to Deci’s collection, use, and disclosure of the Personal Data (as defined below) of the following categories of individuals and organizations:

Website Visitors: individuals who visit our Website and who may volunteer Personal Data.

Customers: parties signing up to our Platform and use the Services, either on their own or on behalf of their employers.

 

TYPES OF DATA COLLECTED AND PURPOSES: 

Depending on your interaction with us, we may collect two types of data from you:

“Non-Personal Data” meaning aggregated, non-personal non-identifiable information, which may be made available or gathered via your access to, and use of, the Service. We are not aware of the identity of the user from which the Non-Personal Data is collected. Such Non-Personal Data may include aggregated usage information and technical information transmitted by your device, such as browser version, operating system type and version, mobile network information, device settings, and software data.

Personal Data meaning individually identifiable information, namely information that identifies an individual or may, with reasonable effort, be used to identify an individual.

For the avoidance of doubt, any Non-Personal Data connected or linked to any Personal Data shall be deemed as Personal Data as long as such connection or linkage exists.

The table below details the types of Personal Data we collect, the methods and purpose of such collection, and our lawful basis for processing such Personal Data, where the EU General Data Protection Regulation (the “GDPR”) and its local implementation in the UK (“UK GDPR”) apply:

We collect your contact data (such as name, email address, name of organization, title, and phone number) when registering to our Platform or submitting web forms on our Services (“Contact Information”).

We may also ask you to submit you Contact Information if you choose to use interactive features of the Services, including participation in surveys, requesting customer support, or otherwise communicating with us.

 

Our legal bases for processing your Contact Information are fulfilling our contractual obligations to you and our legitimate interests. Our legitimate interests in this case are sending communications and providing supports to our Services.

Account Information

When you register to our Services, we will collect information such as name, email address, phone number etc. (“Account Information”).

We collect Account Information in order to enable you to access our Services and ensure the security of your account.

Our legal bases for processing your Contact Information are fulfilling our contractual obligations to you and our legitimate interests. Our legitimate interests in this case are providing our Services in a secure manner.

Payment Information

When Customers sign up for the Services, they provide us with billing information such as bank account numbers, IBAN etc.(“Payment Information”).

Payment Information is collected in order to process payments for purchases, fulfill requests for refunds, returns, or exchanges, and process the redemption of discounts.

The legal bases for processing Payment Information are the performance of our contractual obligations to you and our legitimate interests. Our legitimate interests in this case are processing of payment due to us.

 

Device Information

When you access our Services, we collect information about your device (e.g. IP, MAC Address, UDID, etc.; “Device Information“).

 

 

 

 

 

 

Device information may be collected using Tracking Technologies (as defined below) and shall be collected for purposes of optimization of our Services, analytics and to prevent fraud.

The legal bases for processing Device Information are the performance of our contractual obligations to you, and our legitimate interests. Our legitimate interests in this case are optimizing our Services and keeping them secured.

 

Usage Information

We collect data pertaining to how you interact with our Services (e.g. pages you visited, features you used etc.; “Usage Information”).  

 

We collect Usage Information in order to analyze usage on our Service and improve our user experience and safety. We may also collect such Usage Information for marketing and advertising purposes.

Such collection is based on our legitimate interests, which in this case are operating and promoting our Service and providing you with the best user experience.

Legal Matters

 

We may use certain Personal Data to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts and any other misuse of the Service, to enforce our legal terms and conditions, to protect the security or integrity of our databases, and to take precautions against legal liability.

Such processing is based on our legitimate interests, which in this case are protecting our Service and data, exercising our legal rights, and complying with our legal obligations.

These allow us to automatically collect information about you, your device, and your online behavior, in order to enhance your navigation in our Services, improve our Service’s performance, perform analytics, customize your experience and offer you, for example, tailored content and advertisements that better correspond with your interests.

  1. Strictly Necessary Tracking Technologies – these Tracking Technologies are automatically placed on your computer or device when you access our Services or take certain actions on our Websites. These Tracking Technologies are essential to enable you to navigate around and use the features of our Services. We do not need to obtain your consent in order to use these Tracking Technologies;
  2. Advertising Tracking Technologies – These Tracking Technologies collect information about your browsing habits in order to make advertising more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of an advertising campaign. The Tracking Technologies remember the websites you visit, and that information is shared with other parties such as advertisers or publishers. Publishers, advertisers, and third-party ad networks may also utilize Tracking Technologies or similar technologies to deliver ads and monitor the performance of such ads. The collection of information through Tracking Technologies by such third parties will be governed by their own privacy policies/cookies policies and principles, which the Deci does not control;
  3. Functionality Tracking Technologies – These Tracking Technologies allow our Services to remember choices you make (such as your language) and provide enhanced and personalized features. For example, these Tracking Technologies are used for authentication (to remember when you are logged-in) and support other features of our Services;
  4. Performance Tracking Technologies – These Tracking Technologies collect information about your online activity (for example the duration of your visit on our Services), including behavioral data and content engagement metrics. These Tracking Technologies are used for analytics, research and to perform statistics (based on aggregated information).

The transfer of Personal Data to third party countries is based on the same lawful basis as stipulated in the table at the “TYPES OF DATA COLLECTED AND PURPOSES” section above.

 

ELIGIBILITY AND CHILDREN PRIVACY:

Our Service is not intended for use by individuals under the age of majority, as defined by the applicable law in such individual’s jurisdiction of residence (“Minor“). Deci does not knowingly process Minor’s information and will discard any data we receive from a user that we find or reasonably suspect to be a Minor immediately upon discovery. CONTROLLING VERSION:

This Policy has been drafted in the English language, which is the original and controlling version of this Policy. In the event of any discrepancy between the meanings of any translated versions of the Policy and the English language version, the meaning of the English language version shall prevail.
